UPDATE: It appears I did misunderstand what Balkin meant, and he has made a small clarifying edit to the language I quote above to make clear that he thinks the argument that this law is preempted is stronger than was the case in De Canas v. Bica.

So, do the changes in immigration laws since 1982 mean that the older analysis is inapplicable, or that the application emphasis has changed if Arizona simply follows federal statutes (the essence of the De Canas “mirroring” requirement)?

In fact that law was changed in 1983 and the wording that was troublesome to the argument in De Canas was kept in at 29 USC 1871.
