Pruneyard is the shopping mall case, and holds that there is a free speech right to pass out leaflets (or something similar) at a privately-owned shopping mall notwithstanding the mall owner’s objections.

I would imagine they can find a fourth vote who, if not ready to overrule Pruneyard on its facts, is at least hesitant to extend it to a telephone, of all things.
