It is not a crime to be a racist, so why would a judge be deciding if Clinton Rintoull is or is not a racist. The media quote is garbled, perhaps. There is a difference, legally, between simple assault and a hate crime. Perhaps the judge had decided that this assault did not meet the legal criterion to be a hate crime, although the accused man clearly expressed racist viewpoints. But that is not the same thing. We know little else about the attack from this short report.
